The National Green Tribunal’s order on the Visakhapatnam gas tragedy found LG Polymers prima facie liable under the 19th century English law principle of ‚Äústrict liability‚ÄĚ, which was made redundant in India by the Supreme Court in 1986.
Lawyers say the term ‚Äúabsolute liability‚ÄĚ should have been used instead.
What is strict liability principle ?
  • For, under the ‚Äústrict liability principle‚ÄĚ, a party is not liable and need not pay compensation if a hazardous substance escapes his premises by accident or by an ‚Äúact of God‚Äô‚ÄĚ among other circumstances.
  • The Supreme Court, while deciding the Oleum gas leak case of Delhi, found strict liability woefully inadequate to protect citizens‚Äô rights in an industrialised economy like India and replaced it with the ‚Äėabsolute liability principle‚Äô.
What is ‚Äėabsolute liability principle‚Äô?
  • So, under the absolute liability principle, the apex court held that a company in a hazardous industry cannot claim any exemption. It has to mandatorily pay compensation, whether or not the disaster was caused by its negligence. The court said a hazardous enterprise has an ‚Äúabsolute non-delegable duty to the community‚ÄĚ.
  • ‚ÄúIf any harm results on account of such activity, the enterprise must be absolutely liable to compensate for such harm irrespective of the fact that the enterprise had taken all reasonable care and that the harm occurred without any negligence on its part,‚ÄĚ Justice Bhagwati wrote.
  • The principle of absolute liability is part of Article 21 (right to life) … The courts, to make the legal position clear, should use the term ‚Äėabsolute liability‚Äô in orders and judgments,‚ÄĚ.

In his now-legendary dissenting judgment, delivered at the height of Indira Gandhi‚Äôs Emergency, Justice H.R. Khanna, invoking Justice Brandeis of the U.S. Supreme Court, wrote that ‚Äú[the] greatest danger to liberty lies in insidious encroachment by men of zeal, well-meaning but lacking in due deference for the rule of law.‚ÄĚ

The Supreme Court‚Äôs judgment in K.S. Puttaswamy v. Union of India (2017) is renowned for its incantation, that each of us is guaranteed a fundamental right to privacy. But the Court also recognised that the Constitution is not the sole repository of this right, or indeed of the right to personal liberty. For these are freedoms that inhere in all of us. The Court additionally thought it important, as Justice S.K. Kaul wrote, that the majority opinions of Justice Khanna‚Äôs brethren be buried ‚Äúten fathom deep, with no chance of resurrection.‚ÄĚ

To be sure, the right to privacy is not absolute. There exist circumstances in which the right can be legitimately curtailed. However, any such restriction, as the Court held in Puttaswamy , must be tested against the requirements of legality, necessity and the doctrine of proportionality. This will require government to show us, first, that the restriction is sanctioned by legislation; second, that the restriction made is in pursuance of a legitimate state aim; third, that there exists a rational relationship between the purpose and the restriction made; and fourth, that the State has chosen the ‚Äúleast restrictive‚ÄĚ measure available to achieve its objective.

In this case, not only are the government‚Äôs technological solutions unfounded in legislation, there is also little to suggest that they represent the least restrictive measures available. A pandemic cannot be a pretext to abnegate the Constitution. Inter arma silent leges , said Cicero: ‚ÄúFor among [times of] arms, the laws fall mute‚ÄĚ. But our fight against COVID-19 is no war. Even if it were, our Constitution is intended for all times ‚ÄĒ for times of peace and for times of crises.

1) Operation Twist is when the central bank uses the proceeds from sale of short-term securities to buy long-term government debt papers, leading to easing of interest rates on the long term papers.
2) Whe RBI’s objective is to decrease the interest on long term lending, so that the company’s are able to borrow at cheaper rate for long term to promote economic grwoth…….then RBI purchases debt papers of long term maturity of govt. So, when RBI is purchasing the debt paper, that means RBI is giving loan/money for long term….which results in easy availability of money for long term…henceforth decreasing in long term ineterest rate.
3) If RBI will purchase long term bonds, then the price of long term bond will go up and the yield/return will be low/soften.  (If Rs. 100 bond paper (face value) with interest rate 8% is available in Rs. 110 in the market then the yield will be (Rs.8/Rs. 110)*100  = 7.27%
